Evidently, anyone who develops a taxonomy claims that it is copyrighted.

I have just want to open the discussion to the international legal context rather than the US legal system.

No, you can download the IPC files, but you have to acknowledge WIPO's copyright if you plan a commercial use of the IPC on your site.
