Thanks for the reminder.  I found both of those
posts on another list.  That list is very well
moderated, and the list publisher was the one who
posted the second one.  The first poster was a
respected psychotherapist, as was the list owner.
So I think this case is pretty well founded in
fair use doctrine.      (02)

But for other cases, do you have any suggestions
for how to verify that a post from elsewhere is in
fact available for fair use posting?      (03)

Unfortunately, there is no source of all published
material that has been copyrighted.  Patents are
fully public - that is the basis for granting
exclusive use to a technology IP disclosure in
patent law.  But copyright law simply makes it
illegal to republish copyrighted works, and
requires publications to include the copyright
notice.      (04)

Is there a way to recognize when copyrighted
material has been posted without its legally
mandated copyright marking?    (05)

Isn't a post on a list such as this one legally
included in fair use doctrine if there was no
copyright mark on the original post from the other
list?    (06)

It would be convenient to have a way to identify
when a post has been published in violation of
copyright law.      (07)

you have proper
rights/permission to publish/re-publish anything
you make on your
post. One obviously will not have a problem if you
are the author of
your post, if not, this burden will be on the
poster ... or, at the
least, please make sure one is within the
